All of the properties managed by BRYANT REAL ESTATE are privately owned and are rented on behalf of the property owner, subject to the provisions of the Rental Agreement. Each unit is furnished by the owner to reflect their taste and certain standards recommended by us. Since most reservations are made by phone, it is important for you to communicate your needs to our agents. If you have any special requirements of a particular quality in mind, we strongly suggest a personal visit to the property prior to confirming the reservation. It is unfortunate, but we will be unable to make other arrangements upon your arrival.
The occupancy limit of each property is designated in unit description as LIMIT. Only infants who sleep in cribs are not counted in the total occupancy. All units and cottages are rented for family vacations only. We rent to responsible adults over 25. NO SORORITIES, FRATERNITIES, CHURCH GROUPS, WEDDING RECEPTIONS, "HOUSE PARTIES", "SPRING BREAK" PARTIES, or other such groups are permitted unless pre-approved by the Agent and Landlord at time of reservation. Requests must be in writing. If your request is approved, a substantial Damage Deposit will be required. A rent increase may also be required. Exceeding the occupancy limit, misrepresentation or subletting is grounds for eviction. If your tenancy is for 30 days or less, the expedited eviction procedures set forth in Article 4 of the VRA will apply. Bryant Real Estate reserves the right to enter any rental property to inspect for violation of rules.
Reservations can be made in person, by phone or Internet. A non-refundable Reservation Fee plus tax will be charged to each reservation and disbursed upon receipt of your Advance Rent Payment. After making your reservation we will send you a RENTAL AGREEMENT that must be signed and returned with a 50%, plus extras, ADVANCE RENT PAYMENT by the cancellation date. Once we have received your payment and signed Agreement, we will send you a confirmation. If you are concerned that your Advance Rent Payment may not reach us in time, please call to verify its receipt prior to the Cancellation Date. Due to the large number of reservations made, we will be unable to call you before automatic cancellation on your reservation. While we strive to always provide accurate information, please note that verbal misquotes on rental rates, unit description or policies will not be honored.
CSA Travel Insurance is automatically added to your Rental Agreement. If you choose not to purchase the travel insurance, you must decline it on your first payment by initialing where indicated on the Agreement. This plan is optional but we strongly recommend it. In case of unforeseen events, this insurance helps protect your vacation investment. A pamphlet describing the coverage is included with your Rental Agreement. If you choose not to purchase this coverage, NO REFUNDS WILL BE GIVEN IN THE EVENT OF UNFORESEEABLE CANCELLATIONS, INCLUDING HURRICANE EVACUATIONS. (See Cancellation Policy below). Travel insurance cost is shown on the front of this Agreement. Bryant Real Estate retains a percentage of the insurance premium to offset administrative expenses. Travel insurance cannot be purchased after your final balance is received. Please Note: If you do not decline at the time of first payment, you will have the insurance coverage. To cancel the coverage, you must do so in writing no later than 10 days after payment.
OFFICE LOCATIONS AND HOURS
Our Wrightsville Beach office is located at the corner of Salisbury Street and North Lumina Avenue. The street address is 1001 North Lumina Ave. and the office is open 7 days a week (except Thanksgiving Day, Christmas Day and New Years Day) from 9:00 AM-5:30 PM. Monday through Saturday and 9 AM. to 5 PM. on Sunday. Our Carolina Beach office is located at 1401 N. Lake Park Blvd. in the Snow's Cut Shopping Center and the office hours are 8:30AM to 5:00 PM Monday through Saturday (except Thanksgiving Day, Christmas Day and New Years Day). We may have extended hours for both offices during prime season.
ARRIVALS AND DEPARTURES
When you receive your RENTAL AGREEMENT and CONFIRMATION please read them carefully paying particular attention to the arrival and departure dates. CHECK-IN is 3 p.m. (unless it is noted as 4 PM on the front of your agreement) and CHECK-OUT is 10 a.m. We will adhere strictly to these time schedules so that we can inspect and clean after each departure. Please do not attempt to arrive early or check out late. If the premises are not vacated by 10 a.m. a late check-out fee equal to one-half day will be charged. If you are planning to arrive after 5 p.m., please notify our office so that we can make arrangements for your check-in.
The balance due on your rental must be paid (in US funds) at least 30 days prior to arrival. We accept cash, certified funds, travelers' checks, money orders, personal checks and MasterCard or Visa. Any check returned unpaid by the bank for any reason will incur a $35 Returned Check Fee. Payments for the required 50%, plus extras, Advance Rent cannot be accepted by credit card due to credit card cancellation policies. Reservations made within 2 weeks of arrival must be paid in full by cash, certified funds or credit card. No personal checks accepted at check-in or less than 14 days before arrival. NC Sales & Use Taxes and New Hanover County Room Tax are added to each reservation at the current rate at the time of printing. Tenant will be responsible for payment of taxes applicable at time of tenancy. Taxes will be disbursed upon conclusion of your rental period or upon material breach of the contract.
Tenants will be held liable for any and all damages resulting from their occupancy. Unless you purchase the "Security Deposit Waiver" (see next section), a Damage Deposit ranging from $300 to $3,000, depending on the unit, will be added to your final balance. If your reservation does not require or allow Security Deposit Waiver Insurance, you will be invoiced for any damages, excess cleaning charges, phone calls, cable TV charges, loss or damage to rental linens, etc. Any charges billed to you must be paid immediately or future rentals will be denied. Your Damage Deposit will be refunded within 45 days of departure after deducting actual damages. Any extra services ordered after your arrival (sheets, towels, crib, or high chair, etc.) must be paid at the time of the order. These charges cannot be billed after you go home.
SECURITY DEPOSIT WAIVER INSURANCE
This optional Deposit Waiver covers most accidental damage to the rental unit up to $3,000. Refer to the Description of Coverage mailed with your Rental Agreement detailing full terms and conditions. Purchasing the plan in lieu of paying the Damage Deposit does not negate your responsibilities as a Tenant. The waiver does not cover negligent or willful and wanton conduct. You must notify Bryant Real Estate of any damage or theft to the unit during your occupancy, or this plan is void. If you decide not to purchase the waiver, a Damage Deposit will be added to your final balance. Payments for the waiver will not be accepted after you occupy the unit.
IN THE EVENT OF A HURRICANE
If we are put under a Hurricane Warning and the authorities issue a "MANDATORY EVACUATION" order for your rental location, you MUST vacate your rental unit. Travel insurance coverage is your only option for a refund in the event of a Mandatory evacuation. IF YOU DECLINE INSURANCE, THERE WILL BE NO REFUND. In a "Voluntary Evacuation", there is NO REFUND if you choose to leave.
RESERVATION REQUESTS FOR NEXT YEAR
If you want to reserve the same unit for the same week(s) for next year, you MUST make your reservation request BEFORE departing. All other requests will be accepted on a "first come, first served" basis. A non-refundable Advance Booking Fee must be received within 15 days to hold your tentative reservation. If your tentative reservation is unavailable, the Advanced Booking Fee will be refunded or applied to a new reservation. After rates and owner usage are finalized in January, you will be mailed a Rental Agreement for the required 50% plus extras Advance Rent Payment. These tentative reservations are non-binding until the 50% plus extras payment is made.
FURNISHINGS AND EQUIPMENT
All of the cottages and condominiums are furnished with basic housekeeping accessories, dishes, cookware, flatware and various small appliances. Re-arrangement of furniture is prohibited. MAID SERVICE, LINENS AND TOWELS ARE NOT PROVIDED, except in properties so noted, but are available at additional charge with advance notice. Bed linens and towels should be ordered on your RENTAL AGREEMENT form. Since linen orders are made up and delivered in advance, any orders made after arrival will be subject to an additional $10 Delivery Fee. We have done everything possible to assure accuracy of the description; however we CANNOT be held responsible for printing errors, changes in furnishings by owners, or equipment failure.
Many rental units have restrictions against smoking, boat trailers, jet skis, recreation vehicles and number/size of vehicles. If you have special needs please let us know before confirming your reservation. No Smoking or Smoking Allowed units are designated on your Rental Agreement.
All equipment should be in proper working order, but you should promptly report anything inoperative. After-hours repairs will be limited to emergency situations only. All efforts will be made to expedite repair but NO REFUNDS WILL BE MADE. Guests will be charged for unwarranted service calls. Please keep a key with you when you leave your unit to prevent accidental lock-outs. If we have to come to your unit to let you back in, a key delivery fee of $25 will be charged. If, at the time tenant is to begin occupancy of the property, the landlord or agent cannot provide the unit in a fit and habitable condition or substitute a reasonably comparable property in such condition, tenant shall receive a full refund.
Upon your arrival, please notify us immediately if you do not find the unit clean. If we have not heard from you within one hour of your check-in, we will assume that you found the accommodations in an acceptable condition. All rentals are provided with vacuum, mop and broom. If these items are missing, please call our office. All other cleaning supplies are the responsibility of the renter. Please follow the Check-Out Procedure described in your check-in package or inside the rental unit. Any extra cleaning required by failure to abide by these procedures will result in charges to your rental account. "Maid Service" is available during your stay or on check-out at an additional cost.
Most of our properties DO NOT permit pets in or on the premises. A few rental units will allow one mature, housebroken dog with payment of a $100 plus tax non-refundable Pet Fee. These properties are designated in the unit's description. NO CATS ALLOWED. You must disclose the pet when making your reservation. If a pet is discovered at a "No Pet" property or without advance notice at a "Pet Allowed" property, there will be a $100 charge, the pet must be removed and your occupancy may be cancelled with no refund given. Any damage or excess cleaning required due to pet hair, odor, etc. will be charged to your rental account.
TELEPHONE/CABLE TV CHARGES
Some properties are equipped with phones for local calls unless otherwise noted. The phone number will be on the Confirmation (Area Code 910). Most units have a "block" to restrict direct-dialed long distance calls. Do not attempt to bypass the blocking system. No long distance or toll calls are to be charged to the unit phone. Use your cell phone, calling card or a pre-paid phone card. If you plan to use dial-up Internet during your stay, be sure that your Internet Access number is a local number. Any unpaid telephone or cable TV charges will incur a $15 Administrative Fee.
HOUSE FOR SALE
Occasionally a rental house may go on the market for sale. In such case we reserve the right to show the property to qualified buyers. We will make every effort to schedule the showing at a convenient time and not interrupt your vacation. Your cooperation is appreciated. If your rental unit is sold within 180 days of your rental departure date, your Lease may be enforceable. If sold more than 180 days and no longer offered for rent, we will make every effort to accommodate your needs or refund your advance rent payment.
Bryant Real Estate, on behalf of the owner, reserves the right to cancel the Agreement at any time prior to tenant taking occupancy. All payments will be refunded, and neither management firm nor owner will be liable for any damages of any sort incurred by tenant as a result of such cancellation. If tenant desires to be placed in an alternative rental unit, agent will make a good faith effort to relocate tenant, but tenant agrees to pay difference in cost of rental.
In accordance with the National Association of Realtors Standards of Practice and Code of Ethics, it should be disclosed that Bryant Real Estate has a contractual relationship with the Landlords. This contractual relationship employs us to act as their agents and treat all parties (tenants and landlords) honestly, fairly, and in good faith. More information is available in the office of Bryant Real Estate at your request. The price of any services provided by or through Bryant Real Estate may include a profit for the company.
INDEMNIFICATION AND HOLD HARMLESS
Tenant agrees to indemnify and hold harmless Agent and the owner from and against any liability for personal injury or property damage sustained by any person (including Tenant's guests) as a result of any cause, unless caused by the negligent or willful act of Agent or the owner, or the failure of Agent or the owner to comply with the Vacation Rental Act.
If your reservation is cancelled more than 90 days in advance of your rental period, you will receive a refund of your Advance Rent Payment minus the Reservation Fee and a $75 Cancellation Fee and Insurance premiums are non-refundable. If less than a 90-day notice is given and the unit is not re-rented, there is NO REFUND unless your claim is covered by Travel Insurance. Transfers of confirmed reservations to other units or time periods are treated as cancellations. Transfers of unconfirmed reservations are subject to a $10 Transfer Fee. ALL TRANSFERS AND CANCELLATIONS MUST BE CONFIRMED IN WRITING.
